AMEN REMIT – TERMS AND AGREEMENT TO USE OUR SERVICE

This agreement is formed between you ("our client/customer") and AmenRemit Pty Ltd, trading as AmenRemit Pty Ltd ("AmenRemit"). These Terms and Conditions govern your use of this website and any related services (collectively, the "Service"). By accessing, registering for, and using the Service, you agree to be governed by the Terms and Conditions. If you do not agree to be bound by the Terms and Conditions, do not access, register for, or use the Service. Throughout these Terms and Conditions, the terms "AmenRemit", "we", "us", and "our" refer to AmenRemit Pty Ltd and its employees, directors, successors, affiliates, and assigns. The terms "you" and "your" relate to Service users, whether as Senders, beneficiary owners of Senders, Recipients (money transfer recipients), or website visitors.

Definitions of terms used in this agreement

The following terms and conditions apply.

The terms "you" and "your" refer to the individual who accepts and agrees to the terms and conditions of this Agreement.

The terms "AmenRemit", "we", and "us" relate to AmenRemit PTY LTD.

The term "Services" refers to all payment services and related items made available through this website.

"Sender" refers to a Service user who sends money.

A "recipient" is someone who receives funds from the Service.

The "Destination Country" is the country from which the Recipient gets monies through the Service.

"Beneficiary Owner": According to AUSTRAC, a beneficial owner of a customer is a person (or individuals) who ultimately possesses or controls the customer (directly or indirectly). Ownership involves owning at least 25% of the customer for the purposes of defining a beneficial owner. The notion of 'control' encompasses whether control is exercised through trusts, agreements, arrangements, understandings, or practises, as well as whether the individual has control based on legal or equitable rights. It covers places where a person has authority over financial and operational rules.

A "Transaction" is a precise command to send funds through the Service.

The "Transaction Amount" is the amount of money that the Sender desires to transfer to the Recipient, exclusive of any applicable fees and prior to any currency conversion.

A "Payment Instrument" is a legitimate payment instrument, such as a bank account, debit card, or credit card.

The "Payout Amount" is the amount paid to the Recipient after any currency conversion and before any Local Taxes.

The term "Transaction Fee" refers to the fee in addition to any other charges that may apply to a Transaction.

The term "Service Provider" refers to a local bank, money exchange agency, or other third-party service provider in the Destination Country with whom AmenRemit works to provide the Service.

The "AmenRemit Remittance Facility" refers to the AmenRemit online money transfer platform.

"Verify" indicates that you must go through our verification process in order to help AmenRemit establish your identity.

The term "website" refers to any URL, such as www.Amenremit.com, that we use to provide the Services to you. "Password" refers to the secret password you set up during registration. The "Effective Date" is the date on which our Terms & Conditions take effect.

 

 

A. Initiations

The AmenRemit service is provided by AmenRemit PTY LTD ("AmenRemit", "we", "us", or "our") via our web platform.

This Agreement and the AmenRemit service allow you to send an online money transfer (a "Transfer") to the individual named on the form (the "Recipient"), who will receive the monies in their local bank account. We will integrate new means of electronic or virtual account remittance when they become available, such as a mobile wallet (our "online-to-account" service). Unless we clearly specify differently, these terms and conditions will be amended and will apply to both services.

a.1. For the first time, you must create a "Profile" by providing your personal information, a "User ID" (which is your email address and is used for identification purposes and to login to your Profile), a password, a valid Identification, and a contact number. You can utilise your existing Profile for any subsequent Transfers by checking in with your User ID and password. Based on the information you give, we or our "Service Providers" (businesses contracted by us or our contractors to offer our Remittance Services) will keep and maintain all of the information you submit in your Profile.

A Transfer cannot be sent on behalf of another person.

a.1.1 For online transfers, you can send money either within the same country or to another "Receiving Country." Once we have accepted your Transfer and the funds have been withdrawn from your bank account, the Recipient will be able to retrieve the funds from the bank account you specified on the online form in the agreed currency and at the agreed exchange rate. We will not tell the Recipient until the monies have been deposited. Nonetheless, you or the recipient may receive an SMS notice verifying the completion of the transaction.

a.1.2. Not all nations have access to our services. To enquire about the availability of our services, as well as the addresses and hours of operation of locations that supply them, please contact us or visit our website.

a.1.3. We may communicate with you electronically (through email, for example) unless required by law or regulation to do otherwise. If you choose not to receive notifications electronically, you may not use AmenRemit Remittance Services.

a.1.4. You agree to quickly update your records if your email address or other contact information in your Profile changes. To change your Profile, follow the procedures on our website.

 

 

B. The Services' Composition

AmenRemit Pty Ltd (ACN 649 143 831) is an Australian company based in New South Wales. AmenRemit can be contacted by mail at PO Box Level 26, 44 Market Street, Sydney 2000, or by email at info@Amenremit.com. AmenRemit is an AUSTRAC-registered money transfer service. AmenRemit is solely a Remittance Service Provider; money transfers are our primary business. For security reasons, we recommend that you only transmit money over the Service to people you know personally. If you use the Service to pay third-party vendors for goods and services, you accept that AmenRemit has no control over, and is not responsible for, the quality, safety, legality, or delivery of such products and services, and that you do so at your own risk.

C. Obtaining Service Access and Registration Information

C.1 You must be at least 18 years old to use our Services. You must be competent to create legally enforceable contracts under applicable legislation. AmenRemit shall always negotiate with you as principal and will only interact with you on a transactional basis. Other limitations may apply. Every Transaction is subject to our Terms & Conditions. When you submit a Transaction, you are requesting that we conduct the Transaction on your behalf, an offer that we may accept or refuse from our business location at our sole discretion. However, if we decide not to proceed with the Transaction, we will quickly advise you of our decision and return any money you have paid us.

C.2 When registering to use the AmenRemit Remittance Facility or requesting a Remittance Payment, you will be required to give certain identifying information, such as your name, address, date of birth, occupation, and other information that will allow us to identify you. You promise to submit complete and accurate information during the registration process, as well as to update this information as frequently as is reasonable or required to ensure that it is always complete and correct.

C.3 Your ability to use the AmenRemit Remittance Facility is contingent on our ability to verify your identity. We retain the right to deny you access to our Remittance Facility or to decline your request if you do not submit correct and complete information during registration or when requesting a Remittance Payment. Furthermore, providing inaccurate or incomplete information during registration or while requesting a Remittance Payment may result in problems in your requested remittance payment.

C.4 You give AmenRemit permission to collect a credit report on you and/or information about you or the Payment Account from third parties and financial institutions. The residence address you enter during registration must be the same as the billing address on your debit or prepaid card. AmenRemit may, but is not compelled to, verify your registration information and any other information relevant to a Remittance Payment request. You understand that AmenRemit is reliant on the information you give.

C.5 Each time you use our Remittance Facility, you will be deemed to have acknowledged the accuracy and completeness of all registration information.

C.6 You permit AmenRemit to charge you for the costs of validating your identification if a transaction cannot be completed due to inadequate or erroneous information.

D. The website

You will be able to access content without registering in certain sections of the website. If you register, you will only be able to view specific portions of the website. You will be able to get a username and password after registration, which will allow you to access the Website's private area and utilise the Services. You agree to give accurate and complete information in accordance with the Website's registration form, and to keep this information true and complete at all times. You shall notify AmenRemit immediately if there are any inaccuracies in the information you have supplied. You are completely responsible for keeping all usernames and passwords that enable you access to the AmenRemit website secret and confidential. AmenRemit is entitled to assume that anyone who uses your username and password has your full authority to do so, and accepts no liability for misuse or unauthorised access, unless the use was by AmenRemit employees or you have terminated your account in accordance with these Terms and Conditions.

E. Payment

E.1 You are responsible for ensuring that all Transaction details are correct prior to submission when transmitting payments in accordance with these Terms and Conditions. Typically, after a Transaction has been submitted for processing, its details cannot be changed. To submit a new Transaction, you must give online payment instructions through our website.

E.2 AmenRemit will provide you with the exchange rate, transaction amount, and payout amount. We will also produce a unique Transaction identification number and funding instructions. For each Transaction you submit, you agree to pay us a transaction charge (the "Transaction Fee") in addition to the Transaction Amount. Additional charges may apply. You agree to pay the "Transaction Fee" plus the "Transaction Amount" for your transaction.

E.3 Payment is payable when you submit your Transaction. If you submit a Transaction that causes AmenRemit to incur expenses such as chargebacks or other fees, you agree to refund us for all such charges. To collect payment from you, you permit us to access, charge, or debit funds from any payment instruments you supply to us in connection with your use of the Service (each, a "Payment Instrument" such as your credit card, debit card, PayPal account, or bank account). If your payment fails or is insufficient, you permit us to retry it one or more times using the same or a different Payment Instrument. For example, if your bank account is insufficiently funded at the time you submit your Transaction, we may seek to charge your credit card or discharge your bank account at a later date.

E.4 You represent and warrant that you are the legal owner of your Payment Instrument(s). Are payments received in our account changed to the Recipient? In our present system, s currency will be credited to the Recipient's account within two business days (Saturdays, Sundays, and bank holidays in Nigeria, Ghana, and India are not counted for calculating business days). AmenRemit is not responsible for any delays that may occur if the wire transfer instructions do not include the transaction reference number. You represent and warrant that you own the bank account linked with any payment method you submit.

E.5 AmenRemit and its Service Providers earn a small profit from fluctuating exchange rate margins on a daily and minute-by-minute basis. The currency conversion rate listed on the website is the rate applicable to currency conversion transactions performed on that day and time. It in no way assures or represents the foreign exchange conversion rate that will be applied to the transfer you begin at a later period and time. AmenRemit is not liable for any fees or charges incurred as a result of using a specific Payment Instrument to finance a Transaction. These may include, but are not limited to, unauthorised overdraft fees imposed by banks if there are insufficient funds in your bank account, or "cash advance" fees and additional interest imposed by credit card providers if the Service is viewed as a cash transaction rather than a purchase transaction.

E.6 Banks have defined cutoff times for electronic payment receipt and transmission. As a result, AmenRemit accepts no responsibility for any further payment delays caused by late arrival of funds or payment instructions relative to the selected bank's cut-off times. AmenRemit is not responsible for any fees charged by the recipient's bank as a result of the recipient's receipt of monies.'s bank account. AmenRemit reserves the right to limit the amount that can be sent at any time and at its sole discretion, either per transaction or aggregated. Our customers should be made aware that our online vendor is headquartered in Australia.

 

F. Funds Transfer to the Recipient

F.1 In the Receiver's country, AmenRemit and/or AmenRemit-designated service providers shall arrange the delivery of the Remittance Payment. Payment will be made by crediting the user's or sender's bank account, using a stored value card (if available), or by using another payment instrument. Not all payment methods are available in all countries, and AmenRemit retains the right to change payment method availability at any time. If there are alternative payment methods available besides the Receiver Bank account, AmenRemit maintains the right to choose the manner of payment to the Beneficiary. Although AmenRemit and/or AmenRemit-designated service providers will make reasonable attempts to offer payment in the chosen form, the AmenRemit Remittance Facility is not required to provide all of these payment alternatives for a specific Remittance Payment. If a Receiver cannot be discovered or identified, AmenRemit may, at its option, restore the Remittance Payment monies to you via a credit to your Payment Account or via Check.

F.2 AmenRemit reserves the right to impose identification and verification criteria on a Receiver in order for them to receive monies from a Remittance Payment. AmenRemit may rely on identity information or documents provided by you or the Receiver, including any code or identifier number of the Remittance Payment, when making a payment to the Receiver without additional examination. You agree and understand that AmenRemit has the right to refuse to deliver the payment to the Receiver if the Receiver's identification cannot be verified. Although AmenRemit has the power to impose identification and verification procedures, and failing to comply with them is grounds for refusing to deliver the Remittance Payment, AmenRemit is not compelled to do so.

G. Policies on Cancellation and Refunds

G.1 Please notify us if you have any problems with the Service. You can contact us using the details provided at the conclusion of these terms and conditions. You have the ability to cancel your agreement with us after submitting a Transaction. This cancellation right is valid until seven days after you submitted the transaction, or until we have paid the Payout Amount to the Recipient, whichever comes first. We may charge a cancellation fee if you cancel in accordance with this paragraph. If you include the Sender, as well as the Transaction identification number, Transaction Amount, and the reason for your refund request, we will examine your written request for a refund (sent through email or mail to the address indicated at the bottom of these Terms and Conditions). Any refunds will be issued in the same Payment Instrument and currency that was used to fund the Transaction. There will be no compensation for any currency movements that occurred in the interim. If you receive a refund, we will only return the Transaction Amount if the Transaction was not paid out to the Recipient (in which case your pending Transaction will also be terminated). The transfer charge will not be returned because it represents AmenRemit PTY LTD's administrative expenditures.

 

H. Compilation of Data

H.1 Under Australian legislation, all financial institutions are required to help to the battle against money laundering and terrorist funding by gathering, confirming, and documenting identifying information on all clients, receivers, and beneficiary owners. We may ask you to give us with adequate personal information to enable us to verify your residential address and other personal details in order to validate your identification in line with The AML/CTF Act, AML/CTF Rules, and AML/CTF Regulations. We may seek photographic identification, such as a copy of your passport, driver's licence, and/or another identifying document and/or information, to authenticate your identity. In order to verify your information for the purposes of electronic identification, AmenRemit reserves the right to consult various government and private databases, as well as credit reference bureaux, which may keep a record of that information. We may need more information.

 

I. Privacy Statement

Any information you disclose to us in order for us to provide our Services is protected by the Privacy Act of 1988. You agree that AmenRemit may use such personal data to execute our Services, assess the risk of performing our Services, for the objectives specified in our Terms and Conditions, and, if necessary, to enable AmenRemit to exercise its rights under our Terms and Conditions. You should be aware that: If we are requested or required to provide your Personal Information and/or information regarding your activities while using the Website by the police or any regulatory or government authority investigating suspected illegal activities, or upon receipt of a court order, we will do so; and We reserve the right, in our reasonable discretion, to disclose details of your use of the Website in relation to any, or any threatened, Court Proceeding. The Privacy Statement can be obtained by contacting info@Amenremit.com. You agree that AmenRemit may use your information for marketing and promotional purposes and/or share it with a third party for market research and marketing and promotional purposes.

J. Liability Restriction

J.1 AmenRemit, Service Providers, or their respective subsidiaries, officers, agents, partners, or employees shall in no event be liable for any direct, indirect, incidental, special, consequential, or exemplary damages in excess of AUD100.00 (in addition to refunding the transaction amount and transaction fees).

K. Copyright and Intellectual Property

K.1 You acknowledge and agree that AmenRemit, its information providers, or licensors own all copyright, database rights, and other intellectual property rights connected to the Website's design, layout, procedures, functionalities, data, and content. The Website is owned and operated by AmenRemit. No aspect of the Site, its content, or any of its underlying software or databases may be copied or reproduced, distributed to third parties, reverse engineered, decompiled, or utilised to create a derivative work (in physical or electronic form) without AmenRemit's prior written authorisation. You may only read and save a copy of these pages for personal, noncommercial purposes. You also agree not to use a robot, spider, or other automated device to access the Service, or to remove or change any author, trademark, or other proprietary notice or legend shown on this website (or its printed pages).

L. Complaints

L.1AmenRemit strives to provide the finest possible client service. If you have a problem, AmenRemit will always try to solve it as fast and effectively as possible. You can obtain a copy of our complaint procedures by contacting info@Amenremit.com. If you are dissatisfied with our Service, AmenRemit asks that you contact us in writing as soon as possible via email to info@Amenremit.com and in line with our complaint processes. If the original complaint is verbal, a written complaint must be lodged immediately. We will acknowledge receipt of your complaint within 5 business days. We will evaluate your complaint and give you with preliminary findings within five weeks of receiving it. If you are displeased with how your complaint was handled, we will escalate it internally. If you are still dissatisfied, you may be able to refer your complaint to the Financial Ombudsman Service Australia, GPO Box 3 Melbourne VIC 3001 (Australia), Telephone number 1800 367 287, Email info@fos.org.au.

M. Terms & Conditions Modifications

AmenRemit will notify you in writing of any modifications to our Terms and Conditions via email and/or posting a notice on our Website.

M.1 These Terms and Conditions may be modified from time to time to comply with changes in the law or regulatory requirements, or to reflect market conditions. Will AmenRemit provide seven days? To object to the changes, please send an email to support@Amenremit.com. If you do not reject these revisions within that time frame, they will be assumed to be accepted. AmenRemit will additionally notify you of the effective date of such changes (the "Effective Date"). If the proposed adjustments are rejected, the contract is said to be cancelled. Changes to our Terms and Conditions typically apply only to Services supplied after the Effective Date, unless AmenRemit expressly says otherwise or is required to apply them retrospectively by law or regulatory regulations.

N. There will be no financial advice.

N.1 The Service and material on this Website do not constitute investment or financial advice, and nothing herein should be regarded as establishing a fiduciary, financial, or other advisory relationship between AmenRemit and you or any third party. Any comments or statements made should not be interpreted as investment advice or a recommendation that a specific course of action is appropriate for you. You must read any applicable disclosure document and perform your own research into the correctness, dependability, and completeness of this material before making any investment choice based on any provided reports or information. Furthermore, you should get competent professional advice on the offer in light of your specific financial circumstances and investing needs.

N.2 Your or the Beneficiary's use of the AmenRemit Remittance Facility does not result in the opening of a checking or other form of bank account with us or any of our distribution agents. You and AmenRemit do not have a fiduciary or escrow relationship as a result of the AmenRemit Remittance Facility. The monies held while a Remittance Payment request is being processed are not covered by any of the Australian Government's financial service guarantee schemes or any other government agency.

O. Disclaimer

AmenRemit assumes no responsibility for any errors, omissions, inaccuracies, typographical errors, etc. in the content, nor does it make any representations or warranties regarding any content provided on this website. AmenRemit disclaims any and all liability for the contents. Any action you take based on these information is entirely at your own risk and responsibility. AmenRemit reserves the right, at its sole discretion and whenever necessary, to change any of the foregoing contents at any moment. Without AmenRemit's prior written consent, the contents of this website may not be shown or printed in any manner, in whole or in part.

P. Jurisdiction

P.1 These Terms and Conditions shall be governed by and construed in accordance with Australian law, and any dispute arising in connection with these Terms and Conditions shall be decided exclusively by the courts of Australia. b. Our Terms and Conditions are written in English, which will also be the language of the Contract. All correspondence between us and you will be in English. If our Terms and Conditions are translated into another language, the English version will supercede any translation.

Q. Agreement to the Terms and Conditions.

Q.1 By enrolling for the AmenRemit Remittance Facility, you acknowledge that you have read, understood, and agreed to the terms and conditions of this Agreement. You also certify that you are able to print or download a copy of this Agreement.

Q.2 Any external links to third-party websites on this site are offered for your convenience. We have no control over these sites and are not responsible for their correctness, completeness, legality, or any other element, including the content that they provide. You access these websites at your own risk.
